Legal Question in Tax Law in Massachusetts
i had gone into a place called Instant Tax Service looking for a loan off of my taxes. i was denied and left never signing a paper. whern i went to file my income taxes at another place the irs sent my file back saying that i had already filed. so i called the other place and they said they didnt have any record of it going through. the owner called me back later telling me that a new employee did it and there was nothing he could do abouot it and that it was an honest mistake. now i have no idea where my money is. instant tax service cant even give me a print out of my return. what should i do? should i take them to court?

Generally, a unilateral (one sided) mistake does not release the mistaken party of its obligations under a contract, nor does it allow a party to retain a benefit mistakenly conferred.Your question is very fact specific, and dependent upon the terms & conditions of any agreement you may, or may not, have had with Instant Tax Service.
