Legal Question in Tax Law in Massachusetts

Taxes - wheter to file as "married" or "married filing separately"?

I have been unemployed since May 2009. I have been collecting UI Benefits in the amount of $653, since that time; all of which have not been taxed. I do know about the first $2400 of UI is tax free.

My husband earns just under $200K, and combined with my income both the salary of $66K/yr for the first 4 months of the year and the UI, we are in the highest tax bracket. We purchased a home this year and still own a condo, for a total of 3 mortgages. With no children we are unsure of whether to file jointly or separately, with the concern being we will owe a large sum of money due to not paying taxes on any of my income since June.

The simple answer is to have your tax preparer prepare the tax returns both as married filing jointly and married filing separately. You will then know which is the best for you.

I hope this helps!
