Legal Question in Tax Law in Massachusetts

Testify against ex

As an ex for 7 years can I be made to testify either against or for my ex? I guess he did something wrong with his taxes but they are his taxes with only his name and his signature and we are not and were not married when he did whatever he did. I want no part of this.

Re: Testify against ex

Generally speaking, the rules of evidence in Massachusetts prohibit one spouse from offering testimony against another spouse for communications during the course of the marriage.

Re: Testify against ex

A wife cannot be compelled to testify against her husband, so if this only has to do with things that happened during the marriage you cannot be compelled to testify by anyone.

If it happened after the marriage then you can be subpoenaed.

As long as you have no potential liability then you need not get involved. However, if this has to do with any joint return, I suggest you contact an attorney immediately for assistance.
