If a wife took out a student loan and put the husbands name as a co-signer without his knowledge and the government takes his tax returns because the wife did not pay the loan back, can the husband go to court and get his tax return money back?

If you file a joint return you will not get the money back. Assuming you are still married and file separately you will have a very difficult time proving she used your name without your name or permission.
