Legal Question in Traffic Law in Massachusetts
Car accident liability
Traffic was stopped on a two-lane, two-way street, waiting for train gates to raise. I slowly began to make a right turn onto the street, when the person on the left side of the intersection accelerated to move in front of me, causing me to lightly hit the side of his car above his right rear wheel. Am I liable just because he was on the main street and I was positioned behind him at the end of the incident? Do I have a case?

Re: Car accident liability
Your set of facts clearly defines what a jury case is all about. There is no "just beacuae" theory. Your story would be placed before a jury as would the other driver's and the jury of six would decide the outcome.
