Legal Question in Traffic Law in Massachusetts

My car was hit but I am charged as defendant for leaving the scene.

I was driving on a road when a car pulling out of a parking lot hit my car. The driver hit my car on the passenger side just above the rear passenger side wheel. I have had the car for 15 years and I my son had bonded the area where I was not. The impact broke the bonding. Since I did not think her insurance company would pay a claim for this kind of damage, I told the driver's husband that I would not file a claim. He was screaming at me and approaching in a menacing manner saying the accident was my fault because I ''shouldn't have been there''. As I approached the site of the accident, I observed two cars stopped to turn into the same parking lot with blinkers on. I continued straight because there was room to pass the stopped cars without going over the yellow line. (Chapter 89, Sect 2). A cruiser was called by the person who hit me and I was charged with leaving the scene and violating the yellow line. Although I did leave, I immediately called the police station and reported the accident and left my name and phone # so someone could contact me.
