driving an uninsured car

Hi,

I was rear-ended in May and also got a citation for driving without insurance. The car I was driving belongs to my father-in-law. He did not pay the auto insurance when it needed to renew last Nov. So the plate was revoked. But I had no idea that the insurance for the car got canceled.

My question is how do I convince the court that I am innocent. If I can't get this citation dismissed, what should I do to get this citation not recorded and keep the penalty minimum?

I have my own auto insurance for my own car. Does this help in this case?

Also, the actual citation is ''driving without insurance''. The fact is that I do have insurance. But the car I was driving was not insured. Can I argure that the citation is wrong?

Compulsory insurance violations deal with the cars not the people. If the car was not insured at the time then it is a violation of the statute. Having proof of your own insurance is a good thing to show the court. Charges like these are normally dismissed upon court costs depending upon the persons record and driving history.
