Legal Question in Wills and Trusts in Massachusetts

I have 3 adult children that I have no contact with. I want to be cremated when I die and do not want them having to sign for this. I have a person that I have been with over 20 years and want him handling the arrangements. What do I need for forms?

As you already suspect, you are in great need of a will and other estate planning documents. A will allows you to nominate a person to administer your estate, nominate the guardian of any of your minor children, distribute your assets and property, and set out your wishes for the final disposition of your remains. You might also consider a Health Care Proxy document and perhaps a Power of Attorney instrument.

In addition to Christopher's answer (a good one), generally a spouse has more say-so in arrangements than a friend. Discuss with a Massachusetts lawyer the advantages of marrying the person you are with. (Note that I am not licensed in your state).

You should at a minimum have a Will naming your friend as Executor. I would also have a Medical Proxy and Durable Power of Attorney created for you.

If you would like to discuss this without obligation, please do not hesitate to contact me.
