do you have just 1 yr. from time of death to probate a will?

No. One year is the minimum time for probate, as the statute of limitations against the decedent's creditors is one year after the date of death. Generally, the first account is not filed until at least a year from the date of death.

A person holding a will has 30 days after death to probate the will. The one year time frame has to do with the statute of limitations on the claims of creditors of the deceased.
