Does an aministratrix have to divide 401-k

money equally amongst other people in family

If the 401K has a death benefit, then the death beneficiary gets the money. It is their

money

and not subject to the laws of intestacy. If there is no death beneficiary, then the

asset is part

of the probate estate. As such, it must be subject to the creditors of the estate and

then is

subject to division among all of the heirs.
