Administratrix keeps it all
My mother-in-law died of lung cancer 6 years ago and left no will. My sister-in-law was appointed Administratrix, filing a bond with an unknown value of personal property. A medical malpractice lawsuit was filed shortly thereafter, which continued until last month (5/05) when a settlement was offered to and accepted by the Administratrix. She reportedly already received and spent the money on real estate and personal debts. My father-in-law has no interest in pursuing his interest in the estate. My husband has filed a petition and order to render inventory, which is still pending. What, if anything else, can he do (i.e. complaints, motions, subpoenaes, etc)? I appreciate your time and consideration.

Petition for and Accounting and to have Administratrix removed and replaced and to attached property into which estate assets were deposited. Good Luck!

You ask the Court not only to remove the Administrax, but ask that an attachment be placed on the assets she invested the money. This is in addition to the accounting.
