Legal Question in Wills and Trusts in Massachusetts

I am applying to be an personal administrator. My fiancee's father died in 2008 without a will. Before he died he tried to sell us a car. The car could not be sold to us because it was under a leasing agreement. I payed off the lease however the company would not change his name on the agreement. The car needs to go through probate court. has it been too long since he died? What steps should I take to ensure that My fiancee and I get the car?

Depending upon the size of the deceased's estate, you may be able to file for voluntary administration. This is a simpler and more informal process with less court oversight.

Your fiancee should retain an attorney to determine if her father's estate qualifiies for the more simplified Voluntary Administration. Good Luck!
