Legal Question in Wills and Trusts in Massachusetts

My Brother was killed in a car accident last August and his only heir is myself. We recieved about 20k in personal injury money and that was placed in the estate account. I've been probating his estate and have paid all funeral costs through that account and have about 5 k left over. Now two hosptials are fighting over what is left, becuase he had no insurance. My question is, I now what to have a poem engraved in the back of his headstone and it will cost about 1k. Can I use the money in the estate account before the hospitals get it or has too much time passed?

It depends on the actions now pending against the estate. The hospitals have 1 year to file their claim against the estate.
