How do you sell your parents car when they die?

My condolences on the death of your parent.

You should retain an attorney to determine whether your parent's estate requires a full or abbreviated probate so you can be appointed to act as administrator or executor, if there was, a Will. Good Luck!

You have to probate the estate of the person who died. If the car is the only asset, then it is a small estate and has a simplified process.

There is a form you can get from the RMV that will allow you to transfer title to a family member or to sell the car.

If you are selling it for the estate and the estate is less than $15,000 you can file a Petition for a small estate with the Probate Court.
