Legal Question in Wills and Trusts in Massachusetts

Case law on undue influence after a will is made

Is there any case law about an heir in a will, unduly influencing that person for the remaining years of her life so that she does not change the will? If so, can you cite it? thanks

Cases concerning undue influence are tricky to prove. You can go to your local law library and speak with a librarian to get help with research.

However, I would strongly advise you to hire an attorney who handles probate litigation to evaluate your case. Even if it appears that there might be a case, there are important procedural rules that must be followed to get the needed evidence, get that evidence before the judge, and write the proper pleadings.

There are many such cases. The burden of proof is not that easy.
