Legal Question in Wills and Trusts in Massachusetts

Concealment of a will

In Mass. once someone dies ,when do the children of the deceased get read the will? The executor of my mothers Estate refuses to let us see it and states when he is ready he will get to it.when we ask he calls us money grubbers or states he has no time for this now, its been almost 2 years now ,he has stopped working and has taken several vacations?its not a matter of money its a matter of seeing her wishes are carried out as she wanted. Its not right ,I have a right to know there are 4 surviving children and the oldest has control and is very evasive about it all and doesnt talk about it. My mom had life insurance, stocks and bonds and had sold 2 homes? he says the state took it ALL when she went to a nursing home for less than a year? That is a lot of lifetime savings and investments to be gone? How can i get a copy of that last will?I really want to know what her final thoughts where. Its closure and finality of my moms life with us.

Thanks

Re: Concealment of a will

Assuming probate was filed, the Will and the related documents should be on file at the Probate and Family Court for the county where your mother resided. You can go to the courthouse, ask to have the file pulled, and make copies of the contents. Then go to the Registry of Deeds and find out what happened to the real estate -- you can make copies of the deeds, any liens on record from MassHealth, and anything else that might be there.

Take these copies to an experienced probate attorney. The attorney will review the documents and explain what has or should have been done and what ought to be done next.

Please feel free to call if I can be of assistance.
