Legal Question in Wills and Trusts in Massachusetts

How can I get a copy of a trust

My Father passed away and he created a trust in which per my fathers wife I am one of four to receive a property in Florida but my Fathers wife (not my mother)will not let us see the trust to find out the details. How can we get a copy of the trust or not even the whole trust but only the information pertaining to us.

Re: How can I get a copy of a trust

If the trust was created in a will, you can get a copy from the Probate Court in the county where your father resided at death if the will has been offered for probate. If the trust was created outside the will, then a copy does not need to be filed in the Probate Court so you could request that the trustee provide a copy. The trustee must provide a copy if you are a named beneficiary of the trust.

If it a trust that has not been filed with the court, you may wish to contact an attorney to file action in court to disgorge the contacts of the trust.
