Cremated Remains

Without a will, who has control of a parents cremated remains. The remains are in the center or a disagreement between the only son and daughter of the deceased.

The remains are in the control of the administrator of the estate. If there are no assets to administer and a compromise cannot be reached, then someone will need to petition the Probate Court for authorization to manage the disposition of the remains.

It might be better to try to settle this issue through mediation rather than the courts.
