is hiding a will when you have possession of it ,then file intestate withprobate a crime if so is it a misdemenor

Hiding a will is a crime in and of itself. If the person who hides the will benefits as a result, there are additional criminal charges (ie. larceny, fraud, etc.) not to mention a charge of perjury as well as filing false documents. So there are several felonies associated with the crime proposed.

Hiding a Will is a crime and in all probability will lead to other felonies as well. Moreover, if discovered, you may not benefit at all from the estate as your actions will be deemed such that your attempt to corrupt the process of probate for your own gains and as such breached a fiduciary duty to the estate itself.
Don't Do it. chances are there is someone with a copy anyway and it will be argued the original was merely lossed.

You can also bring this to the attention of the probate court, and have them issue an order to produce the will.
