Legal Question in Wills and Trusts in Massachusetts
Debt collection after death
My sister died leaving a car and 4 debts she was paying off to collections agencies. I sent them all a death certificate. One has sent 2 letters requesting the name of the executor of the estate. My father will become voluntary administrator in the near future.
What is the procedure for notifying the collection agencies we are aware of? Can we ask for validation of the debt - we really know nothing of them. She was paying them monthly.
Do we need a lawyer for this? Thanks

My condolences on your loss.
Whoever petitions to be appointed Administrator should retain an attorney to deal with all of this.
Good Luck!

If one is unsure of how to carry out the duties of executor/administrator, I strongly suggest that he/she obtain legal representation.
In the end, you will spend some money on attorneys fees, but you will ensure that the estate is not taken advantage of, and that every penny possible is preserved for heirs. It may also be possible to discharge thousands in consumer debt.
