Legal Question in Wills and Trusts in Massachusetts

Excutor of estate, time limits

I was appointed exuctor of my mothers estate ( will-filed) in 1998.

I never filed the ''final'' paperwork.

(I have transfered property, notified

other parties, newspaper ad., got waviers for monieis owed to masshealth / estate tax).Is there a time limit to file the final papers? If so, have I ''wronged'' by not filing papers on time / within time limits?

Re: Excutor of estate, time limits

You can file your final account at any time. If no one's complained, there's no penalty; however, the filing fee may be higher because of the delay.

Depending on the complexity of the estate, you may be able to prepare the account yourself, or you can have a probate attorney prepare the account for you. You will need to pull together your bank records (including the cancelled checks) and other financial information.
