Legal Question in Wills and Trusts in Massachusetts
executing missing will?
A friend recently passed away and she had asked my husband to be executor of her will. We do not have a copy of her will and do not know the name of the attorney. What do we need to do to carry out her wishes? Time is an issue because we are concerned about her estate being looted. Thank you in advance for any advice.

Re: executing missing will?
If this has been filed, then then there is probably a file in the probate court where the person died. There you can find who the attorney is, and see the file. If there is no will, or the will cannot be filed, then a blood heir can petition the court, and get control over the property. Should you have any other questions you can contact me.
