How much you have to have to file for estate in court of someone that died. The person had no will and no beneficiary on life ins. policy and 401k. they was engage to someone for many years. they had live together up until 6 months before her death as she went back to be with parents as the mother was very sick and had months to live. the woman die and her mother died 2 weeks later. does the person have any rights of her estate and family is just taken things of hers. Absent a Will the only person or persons entitled to inherit from the deceased are first his spouse, second his children, third his parents and then it goes to his next of kin. A Fiance is not entitled to inherit from his estate.
