Grandmothers Trust and Fathers Second Wife

My father died December of 2005. He left a will leaving everything to his second wife. He also had a trust from my grandmother which his second wife is now receiving. There are six kids from his first marriage and not knowing what was written in my grandmothers will we are wondering if we are entitled to any of the trust that she is now receiving?

As to the trust, to find out who gets the money or payments, you have to read the terms of the trust, and the list of beneficiaries. I would have to do the same thing, if I were to advise. Should you have any more information or more questions, contact me at my office.

You need to read your grandmother's trust. If your grandmother's trust was part of her Will, you may be able to find at the appropriate Probate Court. A will is a public record if it was probated. The Probate Court is located in the county where she resided at the time of her death.

Your father's Will may also contain a reference to the Trust. If his Will was probated, a copy of the trust might have been filed in the probate court records. You could ask the Executor of his estate for a copy of the Trust, or the Executor's attorney.
