Legal Question in Wills and Trusts in Massachusetts

Grandmother's will

My grandmother died a year ago, I just found out that she left my children some money, but my brother destroyed the will and he got everything. My grandmother at the time was on medication due to having cancer so she wasn't herself. What can I do about this?

Re: Grandmother's will

Assuming that the original Will is destroyed and that you cannot find a copy, then the assets of your grandmother's estate should have passed to her heirs according to the state laws of intestacy.

That said, state intestacy laws would not have given "everything" to your brother unless he was joint owner of all of her assets. Find out the name of the Executor for her estate. The local Probate court should have this information.

: Grandmother's will

Try to find out who drafted the will, and see if there is a copy?
