Legal Question in Wills and Trusts in Massachusetts

can i get my house back???

Hi me and my cousin was willed a house that my grandmother's name was also on she was living in the house she asked me and my cousin to sign over our share so she could get a loan to remodel it. we told her no because of her old age. she went behind our back and put our names in the news paper so we could come forward to claim the house but when it was in the paper i didn't see it in there to claim my house. because we didn'tclaim our house the deed went into her name. my grandmother went behind our backs and did this we was in full contact with her so she didn't need to put our name in the paper. now she died and left the house to someone else and we find out that she put the house in someone else name. is it to late for us to get our house back??? confused

Until your grandmother passes away, she has not left anything to you in her will. It is said that a will 'speaks only at death'.

Until a person dies, they are free to revoke or change their will as many times as they wish. In other words, barring another more complicated legal theory, you never owned the house or had a legally enforceable interest in the house.

I am sorry for the loss of your grandmother.
