Legal Question in Wills and Trusts in Massachusetts

My husband had a child (now a man) many years before I met him, the mother put her husband on the birth certificate, before she died she told the child of his father. He has not had anything to do with my husband (other then ask for money at one point, several years ago). When he realized we didn't have any money he didn't contact us again.

How can I protect my children from any claims on our will after our death?

You should meet with an estate planning attorney to review your current estate plan to make sure that it meets your needs. If changes need to be made in order to specifically disinherit an individual, you would be well-advised to make sure that it is done properly with the assistance of counsel. Please feel free to contact our office if you would like to discuss your situation in greater detail.

You and Your husband should meet with an Estate Planning Attorney. Your estate planning documents need to specifically disinherit this young man and other person claiming to be a child of your husband or you that you do not name in your Wills or Trust save for any child born to you and your husband.

Please feel free to contact me if you wish to discuss this in more detail.
