Legal Question in Wills and Trusts in Massachusetts

inheritance

i have a cousin who has died intestate. I have a former aunt in law , married to a long deceased uncle. She has remarried several times since then but thinks she comes in on any inheritance from this cousin who's died. Does she, before blood aunts or cousins?

Re: inheritance

No. Under the law of intestacy, the assets can only go to the next of kin -- blood (or legally adopted) relatives. So, your uncle's children may well have a claim -- but their mother would not.

If your cousin died without leaving any direct descendents, you look "up" the family tree to the parents and branch out from there. Each state has its particular interpretation of the law, and you should discuss the law with a probate attorney who practices in the state in which your cousin died.

Please feel free to contact me if I can be of assistance.
