Legal Question in Wills and Trusts in Massachusetts

Does the Inheritance Go to the State?

Just double checking here on this one. Someone died on SSI with a probate still going on and they were to become a beneficiary, if no will does the state take all of the money?

If there are no other beneficiaries under the probate estate, then the money goes to the state. It is likely if there are other beneficiaries, they will take the deceased beneficiaries share.

Re: Does the Inheritance Go to the State?

No. Any person with an interest in the decendent's estate can petition the Probate court to be appointed administrator and probate the estate distributing any assets after debts and taxes in accordance with the statute on intestate (i.e. without a testament or Will) succession) Good Luck!
