Legal Question in Wills and Trusts in Massachusetts

intestate

I know if a person dies without a will, unmarried, no children or parents it goes to the siblings. But what if the siblings are deceased? Does it go to their children? In what percentage? There is property in both Mass and Texas.

In Massachusetts, the property goes to the nieces and nephews. The property is divided into equal shares. I presume that Texas would treat the inheritance the same way.

Let's say there are three living nieces and one deceased nephew who left two sons. The property is divided into four shares. Each niece takes 25%, and the great-nephews split the remaining 25% (or 12.5% each).

In Massachusetts the property goes to the neices and nephews in equal shares. Texas I would think would have a similar provision.

I would suggest that the deceased's next of kin be notified and an estate be opened for the deceased.
