IRA's and estates

Please help me keep my children speeking to each other.

My two children's mother died several years ago. In her will, she states that the proceedes of her estate to be divided 50/50 between both kids.

The mother also had an IRA listing ONLY ONE of the kids as beneficiary. Are the proceedes from the IRA also to be split 50/50 between BOTH kids or are the proceedes of the IRA a seperate issue from their mothers estate?

Please help me keep my two kids from talking to each other.

Re: IRA's and estates

The IRA is a contract and is not subject to Probate Court or the will. As a result, it is not divided according to the will.
