Legal Question in Wills and Trusts in Massachusetts
Late husband's uncashed claim checks
My husband died 2 months ago before cashing 3 auto insurance claim checks. These checks are all between 1 and 2 years old. They total approximately what he owed on his car. Is there any way I can get them re-issued and sign them over to the lien-holder (who are also listed under ''pay to the order of'' on the checks)?

Yes, assuming you have opened a small estate for your ex-husband, you can write as executrix of his estate and ask that they re-issue the checks. Send them a photo copy of the checks. Ask the court for an order providing for that the checks be issued to you.

I am sorry for your recent loss.
You should call the insurance company and see what needs to be done so that they may re-issue the checks. It *shouldn't* be a problem.
Let me know if I can be of any assistance, or if you would like help probating your husband's will/ administering his estate.
