Legal Question in Wills and Trusts in Massachusetts

I have been living at the same house for many years and I was paying buy the month. But then my landlord said I could pay buy the week. Then They said it was not working even though I was paying them every week. And now they took my sercuity deposit to pay that rent. ARe they allowed to take my sercuity deposit. they never told me what bank or account on the sercuity deposit and I pretty sure I should of been getting interested even if it was only $1.00 can you please help me?? Thank you

If you are current in rent, they can't take the security deposit to pay rent. If you are not current, then the security deposit is available for rent. If the landlord never told you about the bank and the account number for the security deposit, then you have the right to demand a return of the security deposit. Of course, if the landlord properly took the money for unpaid rent, you can't demand the return of the money. A security deposit must be held in an interest bearing account. Interest must be paid to you once a year.
