i was never married.

continuing this question,how do i take control of this house?file a motion to stay?

I am assuming that you were living with someone in a home and that title was in the deceased person's name.

If he died without a Will, his estate passes by statute to his or her relatives. If he or she had a Will, then the Will controls who gets his property.

Unless you can claim an equitable interest in the property that can be confirmed by some kind of writing signed by him, you have a difficult problem. You can make a claim against his or her estate.

For instance if you paid half the mortgage and rendered services to the deceased such as taking care of him, and he promised you that he would leave you the home, you have a claim against the deceased estate.

Absent some promise or debt by the deceased to you, you are pretty much out of luck.
