medical record request

Hi, My mom is deceased, and I would like to get a copy of her medical records. The hospital that I am requesting them from says that I need to go to probate to become a voluntary administrator. My stepfather is listed in the will as the executor of estate. Can I have him request the records, or does he have to go to probate? My mom has been deceased for 9 months

The executor or the administrator of the estate can request medical records, and in their request include the court order that appointed him.

Once your stepfather is appointed Executor/Administrator of your mother's estate, he can request the documents from the Hospital.
