Legal Question in Wills and Trusts in Massachusetts

My mom died in December. In her will monies were left to her granchidren and toheres. If there is inadequate money does her house have to be sold to satify the claims of the beneficiaries.

Without reading the Will, it is not possible to tell you exactly what has to be done. However, if there is a specific bequest and the item being left to the individual no longer exists, then it need not be given. If your mother left $10,000 to my grandchildren and had $10,000 in stock then the Executor should sell the stock and pay the $10,000.

With respect to the home, it depends on the specific language in the Will and without reading the Will I can't be more helpful.

You may have to sell the house. It does depend on how the will was written and how your grandmother gave away her money in the will.
