Legal Question in Wills and Trusts in Massachusetts

Money left in Estate

The attorney for my father;s estate is holding money until the accounting for the estae has been okayed. Should he be sending me a letter stating he is holding this money? He's holding it for any future legal action by one of the heirs.

I am the executrix and will need to pay him from this money.

Re: Money left in Estate

It is not a requirement that an attorney send you a letter stating the amount held pending final acceptance of accounting, but many attorneys consider it good from to do so.

If you know the amount being held, simply send him a letter confirming your understanding and the amount, and if either the understanding or the amount is incorrect to please let you know in writing.

If you don't know the amount, then ask him to confirm the assets he his holding pending the acceptance of the accounting.

If you have additional questions, please feel free to call me.
