Legal Question in Wills and Trusts in Massachusetts
My mother has 4 grown children and 11 grandchildren, living in Massachusetts. She recently had a Will made and has named her 4 sons and only 1 grandchild as Beneficiaries. Can either the sons or other grandchildren contest the Will and anticipate a hopeful success since only 1 of 11 was recognized and the other 10 were ignored?No one knows why she has made so many amnd frequent Wills. She was taken to the attorney by either my brother or his daughter [the questionable grandchild] which is his lawyer to have the most recent done . My Mother is 89 yrs old this year. As to a sound mind-she leaves pans of food on her front step for the wildlife everynight and recently the police were sent to her home to rid a skunk she was "protecting from the elements". She gave up her bedroom to a bunch of cats that have destroyed the woodwork, walls, floors etc. Easily influenced. No question, especuiilly with this granddaughter who is not liked by the family and seems to be a way of Mother to force her upon the rest. This grandchild knows how to play her Grandma like a piano.

If you suspect your Mother is incompetent to handle her own affairs, perhaps you should consider retaining an attorney to petition the Probate Court to appoint yourself or some other suitable person as her guardian or conservator which would also serve to establish medically whether she was competent to make the most recent Will.
