Legal Question in Wills and Trusts in Massachusetts
My mother has a will in the case of her death however if she is incapacitated and needs to go into a nursing home it is my understanding the State of Massachusetts will take and sell her home to pay for her care after insurance/Medicare/Medicaid, etc. runs out. It is my understanding that the home can be signed over at the time she is enrolled in a nursing home to a sibling who is legally disable and receiving disability. Is there specific paperwork I can keep on hand in case this scenario happens?

You need to speak with an experienced elder law attorney. Your understanding is not entirely correct. There are a lot of variables involved here and your mother and you would be best served to fully understand the process and what she may be able to do to prepare for the future. Good luck -
