Legal Question in Wills and Trusts in Massachusetts

My mother-in-law had a quit claim deed drawn up to transfer her condo to her three children in October 2012 and then passed away from lung cancer in December 2012. She had been receiving treatment for the cancer through Mass Health. Can the state of Massachusetts put a lien on the condo that she gave to her children?

Thank you for your question.

I'm sorry to hear that you have lost your mother-in-law. There is a 'look back' period for asset transfers, which is why it is so important to use an estate planning attorney when elders make transfers of assets and property. The answer to your question is yes, and you may want to speak to someone about getting it settled or compromised.
