Notice requirements

If you have a testamentary trust to whom is the executor required to give notice for the affidavit of notice to devisees and legatees? To the trustee, beneficiaries or both?

What if the will contains a pour-over provision?

You give notice to all beneficiaries by statute and under the Will. As a courtesy, you can give notice to the beneficiaries of the Trust, although the Trustee should give notice to the beneficiaries of the Trust.

I would suggest you retain an attorney to assist you with all this including the administration of the trust.
