How do I initiate a Petition to Partition?

I agree with the other answers. After the Petition is filed it must be served upon all parties with an interest in the property; a commissioner is appointed to sell the property and divide the proceeds after costs of sale and the commissioner's fee.

You should have an attorney. The rules are complex and a good attorney will help you meet your goals from this litigation.

You file the petition in the probate court.

You file a Complaint for Partition of Partition in the probate court where the property in question is located.

However, it is not something that should generally be done pro se as there are a variety of rules that will effect the ultimate division of property.
