Legal Question in Wills and Trusts in Massachusetts

Power of Attorney vs. Legal Guardianship

I need to send my cousin, who is currently living with me to high school in MA. Her parents are living in Korea and she is here to study. I want to know what legal forms I need in order to send her to school. What is the difference between Power of Attorney and Legal Guardianship? The parents are not planning on coming to the US. Can I fax them papers for signatures?

Re: Power of Attorney vs. Legal Guardianship

A Power of attorney gives you only the power to do something on behalf of someone else that they would have power to do if they were physically present.

A Guardianship actually empowers you to make caregiving decisions for someone (usually a minor) who could not make them themselves. You can fax documents to be signed but would need to receive back by snail mail the actual original signature. Good Luck!
