probate

can i apply for a inheritance advance while estate is in probate and no formal petitions against the estate have been file?

The answer to your question really depends upon who you are in relation to the deceased and/or to the estate.

You will most certainly want to hire a local attorney to represent you if you have been nominated executor in the deceased's will or are seeking appointment as administrator.

You will want to hire an attorney who practices in the county where the deceased resided at the time of his or her passing. That is where probate will need to be applied for.

It depends on who you are and your relation to the deceased as well as who is appointed as Executor to the Estate.

You need to contact an attorney, preferably one who practices in the county where the deceased resided and his estate is going to be probated.

If there is a Will you will want to have it filed as part of the Probate process.
