Legal Question in Wills and Trusts in Massachusetts

Is Probate Really Neccessary

My father recently passed away leaving a will which left all assets to my mother. Everything that they owned was held jointly by them or he and another person, therefore the estate is really less than $15,000. The two automobiles that he owned were transerred to my mom through an affadavit of Surviving Spouse. He had no debts. Is it really neccessary to file ''Voluntary Probate'' with the Probate Court since he owned nothing solo and had no debts?

Re: Is Probate Really Neccessary

More information is necessary to adequately answer your question. You say that he owned nothing solo, but yet has assets of $15,000. What are those assets? Depending on what they are, it may be necessary to perform the Voluntary Probate.

I would be happy to speak with you if you call me at 401-885-7200.

My condolences on your father's passing.
