relationship being notarized for inherit sister's assets

in order to be eligible to inherit my sister's assets( she died intestate and left only stocks), do i have to have our relationship notarized and present to the probate judge? Whatelse document do I have to prepare. also, can my only brother(one of only two living relative my sister had) take his part of share of her assets, let's say 50% without my consent? Thank you

The estate must be probated. The petition for administration must list all heirs. You then have an opportunity to object. If no petition has been filed, then you can file the peition.
