Legal Question in Wills and Trusts in Massachusetts
Rent or sale of jointly inherited property
My mother passed away leaving a will that divided everything equally between
her five children. Her most valuable possession is her home. Currently two of
her children are living in the home rent free. The other three children would like
to sell the house as soon as possible. Her will states that anything that can't be
divided should be sold and that the will should be settled as soon as possible.
The two children living at home are refusing to pay rent, sell the house or even
allow real estate agents on the property to look at it. All of the children are
adults. How can we get them evicted and how long will it take?

Re: Rent or sale of jointly inherited property
File a Partition to partition the property which may take several months for the Court to determine the value of the five co-tenants respective interests and order either a buy-out or sale. Good Luck!
