If you have lost your spouse, please accept my condolences.

Generally, each debt and expense will need to be looked at independently. For example, a joint credit card that both spouses used will likely fall on the surviving spouse to pay. A debt that is solely in the name of the deceased person is the responsibility of his or her estate alone.

I represent individuals and families in the probate of estates, and would be happy to speak with you. When someone passes away, you want to begin to collect as many bills and financial statements as possible before going to a lawyer.

Please feel free to give me a call. My office is in downtown Boston, but I live in Dorchester. 617-357-4898.

I agree that joint bills are a marital debt. His bills come out of the estate.
