Legal Question in Wills and Trusts in Massachusetts

Getting screwed?

My father died 7 yrs ago and my brother and I were told that we would receive my fathers share of my grandparents will (1/3rd) and my aunt and uncle would receive 1/3rd. Since then my grandmother has passed (5yrs ago) and my grandfather was left everything if she died. My grandfather then changed the will and put his grand daughter in my fathers spot (essencially). My grandfather could not read or write and had my aunt taking care of him. He left his house to her daughter and land to my uncle. My aunt is the executrix and I feel that she may have had some influence on his decision. How can I have my grandmothers wishes be granted? My uncle won't help us and has recently taken all of my grandfathers belongings for himself. She hasn't even filed in probate yet and told me there's nothing I can do.

Re: Getting screwed?

A promise to be placed in a will or to share in an estate is usually not enforceable.

What I gather is that at one time your were named in a will, and then the will was modified to give your apparent interest to another person. You also seem to question the competency of the person who signed the person who signed the will.

In any case, I would need more information to get a sense of this problem. Please contact me.
