Legal Question in Wills and Trusts in Massachusetts
statute of limitations?
Hello. I just have a quick question. My father passed away in 1993. Leaving his wife{my stepmother} and 5 children. she was administrix of estate. We just found out from one of her family members that she had found accounts that we didn't know about and cashed them. I realize the money is gone. I am not after money, I however believe in justice and my father would not have wanted her to do this. Isn't it illegal for her to have done this? forgery and fraud? I am however concerned about the time that has passed. we just found out about all of this. I still dont believe she should be able to get away with it. thank you for your time.

Re: statute of limitations?
Technically, an estate can be re-opened if assets are found subject to distribution. A person in interest must petition the court, with an affidavit stating the reasons. The cost of justice is money. This must be a cost-benefit analysis for you and maybe even the others who stand to gain.
